Terms of Use for JamDrill

Applies to JamDrill: Daily Chord Practice for iOS (bundle identifier com.zcode.jamdrill).

These Terms of Use are the end user licence agreement (EULA) for JamDrill. By downloading or using JamDrill you agree to them. They incorporate Apple's Standard End User Licence Agreement, which also applies to your use of the app.

1. Licence

We grant you a personal, non-transferable, non-exclusive licence to use JamDrill on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service and Apple's Standard EULA.

You may not copy, redistribute, sell, rent, sub-licence, reverse-engineer or attempt to derive the source code of the app, except to the extent that this restriction is prohibited by applicable law.

2. Relationship to Apple's Standard EULA

Apple's Standard End User Licence Agreement applies to JamDrill and is incorporated into these Terms by reference. Where these Terms give you rights or protections beyond Apple's Standard EULA, these Terms apply. Where these Terms conflict with the App Store Terms of Service, the App Store Terms of Service prevail.

You acknowledge that this agreement is between you and zcode, not with Apple, and that Apple is not responsible for JamDrill or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

3. Subscriptions

JamDrill is free to download. Some features require a Premium subscription, sold as an auto-renewable in-app purchase:

Prices are shown in the app in your local currency before you confirm any purchase, and vary by territory. We may change subscription prices in future; Apple will notify you and ask for your consent where its rules require, and you may cancel rather than accept a change.

3.1 Automatic renewal

Subscriptions renew automatically. Payment is charged to your Apple Account at confirmation of purchase. Your subscription renews automatically at the same price and for the same period unless you turn off automatic renewal at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the end of the current period.

3.2 How to cancel

You can turn off automatic renewal at any time in your Apple Account settings:

  1. Open the Settings app on your iPhone or iPad.
  2. Tap your name at the top, then tap Subscriptions.
  3. Select JamDrill and choose Cancel Subscription.

You can also manage subscriptions at apps.apple.com/account/subscriptions, or from the "Manage Subscription" link inside JamDrill. Cancelling stops future renewals; you keep access to Premium features until the end of the period you have already paid for. Deleting the app does not cancel your subscription — you must cancel through Apple as described above.

3.3 Free trials and introductory offers

If a free trial or introductory offer is available, any unused portion of a free trial period is forfeited when you purchase a subscription. Unless you cancel at least 24 hours before a trial ends, the trial converts automatically into a paid subscription at the standard price.

3.4 Refunds

All purchases are processed by Apple, and refunds are handled solely by Apple. We cannot issue refunds, and we have no access to your payment method or billing records. To request a refund, use Apple's process at reportaproblem.apple.com, or contact Apple Support. Refunds are granted at Apple's discretion under the App Store Terms of Service and any statutory rights you have in your country.

3.5 Restoring purchases

If you reinstall JamDrill or move to a new device, use the "Restore Purchases" option in the app to recover an active subscription associated with your Apple Account.

4. Acceptable use

You agree to use JamDrill only for lawful purposes and not to interfere with its normal operation or attempt to gain unauthorised access to any part of it.

5. Intellectual property

JamDrill, including its software, audio content, chord and theory material, design and branding, is owned by zcode and protected by copyright and other laws. These Terms grant you a licence to use the app; they do not transfer ownership of anything to you.

6. Privacy

Our handling of data is described in the JamDrill Privacy Policy. In summary, JamDrill collects no personal data and stores your practice data only on your device.

7. Disclaimer of warranties

To the fullest extent permitted by law, JamDrill is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted or error-free.

Nothing in these Terms excludes or limits any rights you have as a consumer under the mandatory laws of your country that cannot lawfully be excluded.

8. Limitation of liability

To the fullest extent permitted by law, zcode will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data or profits, arising out of your use of or inability to use JamDrill. Where liability cannot be excluded, it is limited to the amount you paid for the app and its in-app purchases in the 12 months before the claim arose.

9. Termination

This licence continues until terminated. It ends automatically if you fail to comply with these Terms. You may end it at any time by deleting JamDrill from your devices. Cancelling a subscription is a separate action, described in section 3.2.

10. Changes to these Terms

We may update these Terms. The current version is always published at this address, with the "Last updated" date shown above. Material changes affecting an active subscription will take effect no earlier than your next renewal.
